In the reported incident, New South Wales Police stopped Warner and carried out a random breath test. Australian media reports say the test indicated he had consumed alcohol above the permitted threshold.
The alleged blood alcohol concentration recorded was 0.104, a figure that is described as more than double the legal limit in Australia. Based on the result, Warner was charged, arrested, and taken to Maroubra Police Station.
Police provided details of the procedure in a statement that referenced the timing and location. It said: “About 5:30pm today (Sunday 5 April 2026), police were conducting stationary random breath testing on Malabar Road, Maroubra.”
The statement added that a van was reportedly seen pulling in short of the testing area and parking. Officers from the Traffic and Highway Patrol Command then approached the vehicle and tested the driver—described as a 39-year-old man—at the roadside, with the result coming back positive.
It further claimed that Warner was arrested and brought to Maroubra Police Station, where a second breath test allegedly confirmed the reading of 0.104. Following that, he was issued with a Field Court Attendance Notice related to a “drive with middle-range PCA” charge.
Warner has been told to appear in court next month. The notice specifies a hearing before the Downing Centre Local Court on Thursday, 7 May 2026.
